Welcome to Pink.Flowers! The terms “we”, “us” and “our” refer to Pink.Flowers. Pink.Flowers operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated floral subscription experience (the “Services”). Pink.Flowers is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 – ACCESS AND ACCOUNT
You must be at least 18 years old to use our subscription services. You agree to provide accurate and complete information when setting up your subscription, including your delivery address in our local Cape Town delivery area.
You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
SECTION 2 – OUR PRODUCTS
Our subscription provides fresh seasonal flowers, delivered locally on Wednesdays and Fridays only. Colours and flower varieties may vary due to seasonal availability. Images on our site are examples only and actual arrangements may differ.
SECTION 3 – SUBSCRIPTIONS & RENEWALS
- Your subscription renews automatically based on your selected frequency - weekly, bi-weekly, or monthly - on the same day of the week as your first delivery (not necessarily the same calendar date each cycle).
- Deliveries are made only on Wednesdays and Fridays within our Cape Town delivery area.
- Subscriptions continue until cancelled. You can cancel at any time by emailing hello@pinkflowerscpt.com or via your customer account.
- Cancellations must be made at least 4 days before your next scheduled delivery to avoid being charged for the next delivery cycle.
SECTION 4 – PRICES AND BILLING
All prices are listed in South African Rand (ZAR) and are inclusive of VAT unless otherwise stated.
Payment is processed automatically on your renewal date. You agree to provide valid and up-to-date payment information.
SECTION 5 – SHIPPING AND DELIVERY
- We deliver only within our specified local Cape Town delivery area.
- If no one is available to receive the flowers and no safe place is provided, we may return the flowers to our studio and arrange redelivery for a fee.
- We are not responsible for delays caused by factors beyond our control (e.g., extreme weather, strikes, road closures).
SECTION 6 – REFUND POLICY
Please refer to our Refund Policy for full details. In summary:
- No refunds are given for partially used subscription periods.
- Damaged or incorrect deliveries must be reported within 24 hours with photos.
- Refunds or replacements will be offered at our discretion.
SECTION 7 – INTELLECTUAL PROPERTY
All content, images, and designs on our website are owned by Pink.Flowers and may not be used without permission.
SECTION 8 – THIRD-PARTY LINKS & TOOLS
We may provide links to third-party websites or services. We are not responsible for their content, accuracy, or practices.
SECTION 9 – LIMITATION OF LIABILITY
To the maximum extent permitted by South African law, Pink.Flowers will not be liable for any indirect or consequential loss arising from your use of our Services.
SECTION 10 – GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
